Regulations for the provision of services within the STEAM Academy online platform

  (hereinafter referred to as the Regulations)

§ 1

 

General provisions

 

 

 

1. These regulations specify the rules for the provision of electronic services offered by the STEAM Polska Foundation with its registered office in Warsaw (address: Marymoncka 129/20, 01-946 Warsaw), entered into the register of associations and foundations of the National Court Register under KRS number 0000988992, with the NIP number 1182247013 and REGON 522971640, hereinafter referred to as the Organizer, within the STEAM Academy online platform, hereinafter referred to as the STEAM Academy Platform or STEAM Academy;

 

 

 

2. The STEAM Academy is a training platform available on the Internet at www.steampolska.org, within which the Organizer provides online training, in particular in the form of lectures, conferences, webinars, workshops and demonstration classes with children or teenagers, hereinafter collectively referred to as Training in in the form of video or audio recordings or transmissions, possibly accompanied by supporting materials regarding modern teaching methods, including: the STEAM method for children and young people and intended, among others, for educators, teachers, parents and guardians, as well as all other people interested in the above issues.

§ 2

 

Access to STEAM Academy services

 

 

 

1. The recipients of services provided by the Organizer as part of the STEAM Academy Platform, hereinafter referred to as the Recipients, may be:

 

a. public and private primary and secondary schools and kindergartens, as well as other entities employing teachers or educators of children or youth, hereinafter referred to as Institutional Recipients;

 

b. other natural persons, legal persons or entities without legal personality, hereinafter referred to as Individual Recipients.

 

 

2. By acquiring the right to access the Trainings made available on the STEAM Academy Platform, the institutional recipient indicates the natural persons employed by him or cooperating with him (especially teachers, coordinators of the Future Laboratories and educators) who will use the Trainings, hereinafter referred to as Users. The individual recipient is also a User.

 

 

3. The STEAM Polska Foundation offers the possibility of paid online use of Trainings and educational materials attached to them, and enables Recipients to acquire the right to access:

 

a. one Training;

 

b. a package of Trainings, selected by the Recipient or grouped by the Organizer, e.g. according to the criteria of subject matter, person conducting the Training, etc., hereinafter referred to as the Training Package;

 

c. all Trainings offered as part of the STEAM Academy Platform, if this is provided for in the Organizer's current offer.

 

 

4. The Recipient may purchase the right to access any number of Trainings or Training Packages.

 

 

5. Each User gains access to the selected Training or Trainings for a period of 12 months, counted from the date of registering the payment in the Organizer's system. The Organizer may specify in its offer a different time of access to individual Trainings than that indicated in the preceding sentence.

 

 

6. The provisions of section 5 do not apply to Training in the form of live online broadcasts (in particular teleconferences, webinars), available only on the dates specified by the Organizer. The Organizer may make a recording of the online broadcast and make it available to Recipients under the terms set out in these Regulations.

 

 

 

7. If the Recipient later acquires access to subsequent Trainings or Training Packages, the dates during which these Trainings remain available to the User are counted separately for each of them.

 

 

 

8. In order to obtain the right to access the Trainings offered by the Organizer, the Recipient must:

 

a. register using the form available on the website www.steampolska.org or by phone by contacting the Organizer's representative;

 

b. submit a declaration that you have read the content of these regulations and accept its provisions, as well as that you have read the principles of personal data processing by the Organizer;

 

c. pay the fee referred to in § 3.

 

 

 

9. In the case of Users for whom the right to access Training has been acquired by an Institutional Recipient, the condition for starting to use the Organizer's services provided as part of the STEAM Academy is to submit a declaration of reading the content of these Regulations and accepting its provisions, as well as reading with the principles of personal data processing by the Organizer.

 

 

 

10. When registering, the individual recipient provides his/her personal data, including: name, surname, e-mail address, telephone number. An individual recipient may indicate which group of customers he/she belongs to from the list provided by the Organizer: parent, guardian, teacher, etc.

 

 

 

11. When registering, the institutional recipient provides the name, surname and e-mail address of the authorized person.

 

12. The institutional recipient may indicate any number of Users who will use the Trainings to which they have acquired access and add new and remove existing Users throughout the period referred to in section. 5.

 

 

13. When providing the Organizer with the personal data of the indicated Users, including in particular their name, surname and e-mail address, the institutional recipient is obliged to submit a declaration that it provides such personal data with the prior, express consent of the persons to whom the data relates or to enter into an agreement with the Organizer as an entity processing the contract for entrusting the processing of personal data.

 

 

14. After registration, the Organizer sends the Recipient confirmation of registration along with data enabling logging in to the system. An individual recipient who is a consumer is additionally informed about his statutory right to withdraw from a distance contract referred to in § 8 section 1 and that this right expires in the situation referred to in § 8 section 2 of these Regulations.

§ 3

Fees

 

1. For acquiring the right to access the Trainings referred to in § 2 section 3, the recipient is obliged to pay the Organizer a fee in the amount indicated on the page on the Organizer's website. The Organizer, as part of special offers or organized promotional campaigns, is entitled to introduce discounts in relation to the prices indicated in the price list referred to in the preceding sentence.

2. The fee referred to in section 1 must be paid by transfer to the bank account indicated on the invoice issued by the Organizer or via online payment.

3. In the cases of resignation referred to in § 8 section 2 the fee paid by the Recipient is refundable in full.

 

4. The Organizer may, in particular as part of organized promotions, provide Users with free access to selected Trainings. The rules of access to these Trainings are specified in the promotion regulations.

§ 4

Rules for using Training

 

1. The training consists of educational films in the form of multimedia files, available online via a web browser with JavaScript enabled, or in the form of an audio-video transmission (streaming), taking place on a date specified by the Organizer.

2. Neither the Recipient nor the User may disclose their login details to the STEAM Polska Academy system to any third parties and acknowledge that violating the prohibition referred to in the preceding sentence constitutes a gross violation of these Regulations.

3. Each User, for the entire period for which they have acquired the right to access Training in the form of multimedia files made available on the website of the STEAM Polska foundation, may use them at a time and place of their choosing, including playing video recordings many times and without time limits. , on which the Training data was recorded.

4. Live broadcast training takes place on the date specified by the Organizer. If the Recipient fails to exercise the right to participate in the Trainings referred to in the preceding sentence, the Recipient is not entitled to a refund of fees paid to the Organizer, unless he/she exercised the right to withdraw from the contract concluded with the Organizer or the right to resign on the terms set out in this Regulations or mandatory provisions of law.

5. Each User should provide their own computer or other device enabling access to the Internet in order to use the Trainings. The Organizer is not responsible for the quality of the equipment, software or Internet connection used by the User.

 

6. After completing a given Training, the User may receive a certificate in the form of an electronic document confirming participation in the Training, including its topics, instructors and number of hours. The Organizer may make the issuance or automatic generation of a certificate conditional on the User passing self-tests, if any have been prepared for a given Training. The certificates referred to in this section may be issued or generated automatically no later than the date of expiry of the User's access to the Trainings, in particular due to the expiry of the time for which the access was purchased.
 

§ 5

Copyright

 

1. The copyright to published educational materials created for the use of the STEAM Academy belongs to the Organizer.

2. Copyright protects in particular texts, graphics, photos, sounds, videos and other materials made available by the Organizer, as well as the graphic design and the selection and arrangement of content from the Organizer's published educational and promotional materials.

3. Copying, using and disseminating educational and promotional materials, texts, graphics, photos, sounds, videos and other materials made available by the Organizer is permitted only with the prior consent of the Organizer expressed in writing. In particular, any recording (saving, recording on a storage medium or network resources) or copying of audio or video recordings made available as part of the Training without the consent of the Organizer is prohibited and constitutes a gross violation of the provisions of these Regulations.

4. When registering, the Recipient may send the Organizer any information or data regarding third parties only with their prior, express consent. Otherwise, he shall be fully and exclusively liable towards the persons whose rights he has violated.

5. The Organizer allows the use of published educational materials created for the purposes of Training and made available to Users as part of the STEAM Academy only by authorized Users and only for their personal educational purposes. In particular, any distribution of educational materials in the form of documents or presentations downloaded by the User is prohibited.

6. A user who is a teacher is entitled to display fragments of the Training indicated by the Organizer during meetings or meetings with parents and guardians, if this is clearly indicated in the description of a given Training.
 

§ 6

Personal data protection

 

1. The administrator of personal data of individual Recipients who are natural persons, persons acting on behalf of Recipients who are not natural persons and Users is the Organizer.

2. The condition for using the Organizer's services provided as part of the STEAM Academy is strict compliance with the principles of personal data protection, in accordance with the principles set out by the Organizer and in mandatory legal provisions. Violation of these rules, including in particular any attempt to violate the security rules of the IT system supporting the STEAM Academy, including an attempt to gain unauthorized access to personal data processed by the Organizer, constitutes a gross violation of the provisions of these Regulations.

3. The Organizer processes the following personal data of individual Recipients and persons representing institutional Recipients: name, surname, e-mail address, telephone number and possibly the name of the function performed. In the case of individual Recipients, the Organizer also processes the address of the place of residence or another address indicated by them and the bank account number, as well as the NIP number and possibly the REGON number, if the Recipient uses the STEAM Academy as part of their business activity. In the case of Users' personal data provided by an institutional Recipient, the Organizer processes their name, surname, e-mail address and possibly telephone number.

4. Personal data indicated in section 3 The Organizer processes only in order to enable Recipients and Users to use the Organizer's services referred to in these Regulations and to properly fulfill the Organizer's obligations arising from the provisions of these Regulations and contracts concluded on their basis, as well as to settle payments made for participation in the use of the Organizer's services. . The legal basis for the processing of personal data of individual recipients who are natural persons and persons representing institutional recipients is Art. 6 section 1 letter b), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (Journal of Laws .UE. L. of 2016, No. 119, page 1, as amended), and Users reported by Institutional Recipients - Art. 6 section 1 letter a) and b) of this Regulation.

5. Based on a separate, voluntarily granted consent, the Organizer may process the personal data of the Recipient or User, including his or her e-mail address and telephone number, for the purposes of advertising and marketing the services provided by the Organizer, in particular for the purpose of informing about the current service offer. Organizer provided as part of the STEAM Academy.

6. Providing personal data referred to in section 3 is voluntary, but is necessary for the provision of services by the Organizer. Refusal to provide personal data or exercise the right to request deletion
 

§ 7

Violation of the provisions of the Regulations

 

1. In the event of a violation of the provisions of these Regulations or mandatory provisions of law by the Recipient or the User indicated by him, the Organizer will immediately notify the Recipient of this, indicating the type of violation and requesting it to be discontinued and its effects removed.

 

2. If the violation continues or the Recipient refuses to remove its effects despite the Organizer's request, the Organizer may temporarily or permanently block or limit the Recipient and the Users indicated by him/her access to the resources of the STEAM Academy.

3. If a violation of the Regulations or legal provisions referred to in section. 1 is of a gross nature, including if it constitutes a violation of copyright, the security principles of the Organizer's IT system, the principles of personal data protection, threatens the integrity or security of data processed in this system or otherwise directly exposes the Organizer to damage, the Organizer may immediately block the Recipient and the Users indicated by him have access to the resources of the STEAM Academy, before sending the request referred to in section 2.

 

4. In the event of blocking or limiting the Recipient's access to the services provided by the Organizer as part of the STEAM Academy as a result of violating the provisions of the Regulations or legal provisions referred to in section. 1, the fee paid to the Organizer referred to in § 3 is non-refundable.

 

5. In the event of a violation of the provisions of these Regulations, the principles of personal data processing or mandatory provisions of law by the User indicated by the Institutional Recipient, this Institutional Recipient shall be liable to the Organizer on a risk basis.
 

§ 8

Right to opt out. Termination of the contract

 

1. An individual recipient who is a consumer may, without giving a reason, withdraw from the contract concluded with the Organizer, the subject of which is the use of Training under these Regulations, within 14 days from the date of payment to the Organizer of the fee referred to in § 3 section. 1. The declaration of withdrawal from the contract should be sent in paper form, by registered mail, to the postal address of the Organizer's registered office indicated in § 1 section 2 of the Regulations or in document form as a scan electronically to the following e-mail address: kontakt@steampolska.org. The deadline is deemed to have been met if a registered letter is sent or e-mail correspondence containing a scan of the resignation is sent within the 14-day period indicated above. If the consumer exercises the right to withdraw from the contract, the fee paid will be refunded within 14 days from the date of receipt by the Organizer of the declaration of withdrawal from the contract, using the same payment method that was made.

 

2. The rights of the Recipient who is a consumer referred to in section 1 expires when he starts using the services provided by the Organizer. The beginning of using the services is understood as the first logging in of the Recipient to the STEAM Academy system in a way that allows viewing the materials available as part of the training.

§ 9

Final Provisions

 

1. In matters not regulated by these Regulations, the relevant provisions of generally applicable Polish law, in particular the Civil Code, shall apply.

 

2. All comments and reports regarding violations of these Regulations should be sent to the e-mail address kontakt@steampolska.org or to the address of the Organizer's registered office.

3. All disputes between the Organizer and Recipients who are not consumers shall be resolved by the common court having jurisdiction over the Organizer's registered office.
